Terms of use

1. Purpose

These terms of use govern the use of Affixe, an online service published by CHAFFY LABS that lets kennels build and run their website: pages, breeding dogs, litters, applications, reservations and messages (the "Service"). They apply to anyone who creates an account (the "User").

Paid subscriptions are additionally governed by the terms of sale.

2. Account

Sign-up uses an email address, to which a sign-in link is sent. The User is responsible for keeping access to their mailbox confidential and for actions taken from their account.

A kennel can have several people: the owner who created it, and the collaborators they invite, within the limits of its plan. The owner is answerable for their collaborators' actions.

3. Content published by kennels

The User is solely responsible for the content they publish (text, photos, information about animals, prices) and for its lawfulness. In particular, they undertake to comply with the rules governing breeding and the sale of animals, including the mandatory information in offers set by the French Rural Code, and to publish only content they hold the rights to.

They grant CHAFFY LABS, for the time they use the Service only, a free, non-exclusive licence to host, reproduce and display that content, strictly as needed to run the Service.

CHAFFY LABS does not review this content beforehand. It promptly removes or disables access to any manifestly unlawful content reported to it, and may suspend the website concerned.

4. Prohibited uses

• publishing unlawful, misleading or abusive content, or content infringing third-party rights;
• using the Service to offer animals in breach of the regulations, in particular without the mandatory information;
• attempting to disrupt the Service, bypass its technical limits or access other kennels' data;
• sending unsolicited communications through the Service.

5. Visitors' personal data (processing on behalf of kennels)

Applications, messages and reservations collected by a kennel's website are collected on behalf of that kennel, the data controller. CHAFFY LABS acts as a processor within the meaning of article 28 of the GDPR, and undertakes to:

• process this data only on the kennel's instructions, to provide the Service;
• keep this data confidential and protect it with appropriate technical and organisational measures;
• use only the sub-processors listed in the privacy policy, and inform the kennel of any change;
• help the kennel answer requests from data subjects, and notify it of any data breach without undue delay;
• delete this data when the kennel is closed, after letting it export the data;
• make available the information needed to demonstrate compliance with these obligations.

6. Availability

CHAFFY LABS strives to keep the Service available at all times, with no guarantee of uninterrupted access, in particular during maintenance or a provider's outage. It is bound by a best-efforts obligation only.

7. Suspension and closure

The User can close their kennel at any time from its settings. CHAFFY LABS may suspend or close an account in the event of a serious breach of these terms, after a formal notice has gone unheeded, except in an emergency or where required by law.

8. Liability

CHAFFY LABS is not a party to dealings between a kennel and its visitors, nor to sales of animals. It can only be held liable for proven fault, and within the limit set by the terms of sale for subscribers.

9. Changes and governing law

CHAFFY LABS may change these terms; Users are informed at least 30 days before a substantial change takes effect. These terms are governed by French law. The French version prevails.
